ACCIÓN ECOLÓGICA DENUNCIA ANTE EL MUNDO**

**EL LAUDO ARBITRAL DE LA HAYA EN EL CASO CHEVRON/TEXACO ORDENA **
**AL ESTADO ECUATORIANO VIOLAR LOS DERECHOS HUMANOS**

El 30 de agosto de 2018, el Tribunal de la Corte Permanente de Arbitraje
de La Haya falló en contra del Estado ecuatoriano en el caso
Chevron/Texaco, perjudicando a decenas de miles de personas afectadas
por las operaciones de esta empresa en la Amazonía ecuatoriana. Ante ello:

1.  Rechazamos el laudo arbitral pues burla 25 años de lucha en demanda
de justicia y reparación integral para miles de personas afectadas por
la contaminación petrolera en el norte de la Amazonía. El Estado
ecuatoriano nunca debió haber aceptado ir a un tribunal de arbitraje.
Recordemos que fue aceptado en 2011, cuando ya teníamos una Constitución
que prohíbe ceder soberanía a instancias de  arbitraje internacional en
controversias contractuales o de índole comercial, entre el Estado y
personas naturales o jurídicas privadas (Art. 422). El de La Haya es un
tribunal que garantiza inversiones, no puede pretender decidir sobre
derechos humanos y de la naturaleza. Los tribunales de arbitraje sirven,
como lo dice su nombre, para proteger inversiones, empresas, no a los
pueblos.

2. Condenamos el abuso de poder y el abuso de las instancias legales que
hace la empresa Chevron Texaco. No sólo agotó las instancias nacionales,
sino que asfixió a los jueces con millares de folios para demorar el caso.

3. Denunciamos que lo que está ocurriendo es parte de una campaña de
Chevron para que quede en la impunidad el delito ambiental y social que
cometió en la Amazonía ecuatoriana. Como parte de esta campaña se ha
activado el gobierno de Estados Unidos. Recordemos que durante la
reciente visita al Ecuador de Mike Pence, vicepresidente de ese país, se
refirió a que éste era un tema incómodo que debía ser resuelto.

4. Recordamos que el juicio de los afectados por ChevronTexaco es de los
afectados, no de los gobiernos, ni del presente, ni del pasado.

5. Exigimos al gobierno nacional declarar el laudo inaplicable, sin
perjuicio de establecer responsabilidades por la aceptación, la mala
defensa, la falta de investigación.

6. Convocamos a las organizaciones ambientales, de derechos humanos,
trabajadores, indígenas, mujeres, a castigar a la empresa repudiando sus
productos, sus operaciones, sus pretensiones de impunidad. Pedimos
enviar fotografías expresando su rechazo a Chevron así como su apoyo a
los pueblos que demandan la reparación de sus derechos y la restauración
de la Amazonía afectada.

*THE RULING OF THE PERMANENT COURT OF ARBITRATION IN THE HAGUE THAT THE
ECUADORIAN STATE
MUST VIOLATE HUMAN RIGHTS IN THE CHEVRON/TEXACO CASE *
*SHOULD BE REPUDIATED*

On August 30, 2018, a Tribunal of the Permanent Court of Arbitration of
The Hague ruled against the Ecuadorian State in the Chevron/Texaco case,
ordering that the Lago Agrio Judgement of 2011 against the company not
be enforced, and thereby bringing harm to tens of thousands of people
that have been affected by its operations in the Ecuadorian Amazon.

In the face of this outrage, Acción Ecológica:

1. Rejects the arbitration award because it mocks 25 years of struggle
to demand justice and comprehensive reparation for thousands of people
affected by oil pollution in the northern Ecuadorian Amazon. The
Ecuadorian state should never have agreed to take this matter to a court
of arbitration. At the time this action was taken in 2011, Ecuador
already had a Constitution that prohibited the cession of sovereignty
through international arbitration in contractual or commercial disputes
between the state and natural or legal persons (Article 422). The
Permanent Court of Arbitration in The Hague was set up not to render
judgement on questions of human rights and nature, but to arbitrate in
international disputes among states and businesses regarding investment
and other treaties.

2. Condemns the abuses of power and of the legal system committed by
Chevron/Texaco. Not only has the company exhausted every legal recourse
in the country; it has also smothered judges with thousands of pages of
documents intended to delay a resolution of the case.

3. Denounces Chevron’s campaign to ensure that the environmental and
social crimes that it has committed in the Ecuadorian Amazon continue to
go unpunished. This campaign has gone so far as to enlist the United
States government: during his recent visit to Ecuador, US vice president
Mike Pence referred to the Chevron/Texaco case as an uncomfortable issue
that needed to be resolved.

4. Reminds all parties that the original Chevron/Texaco legal case was
about those affected by the company’s operations, not about any
government either past or present.

5. Demands that Ecuador’s government declare The Hague Tribunal’s award
inapplicable, without prejudicing or precluding any future efforts to
establish who was responsible for allowing the matter to go to the
Permanent Court of Arbitration in the first place or why the case was so
poorly pursued there.

6. Requests environmental and human rights organizations, as well as
workers, indigenous people and women, to carry out their own punishments
of Chevron by rejecting its products, its operations and its claims of
impunity. We ask friends to send us photographs expressing their
opposition to Chevron and their support for the peoples demanding
reparations and the restoration of the affected Amazonian territories.
